These Terms & Conditions govern your use of this website and set out the basis on which Creative Cultivation provides garden design and build services. By using this website you agree to these terms. Where we are engaged for a project, a separate written proposal or contract will also apply and, if the two differ, that written agreement takes precedence.

You may view and print pages from this site for your own reference. You may not copy, republish or redistribute the content commercially without our written permission.
We make reasonable efforts to keep the site available and accurate, but we do not guarantee uninterrupted access and we may change or withdraw content at any time.
An enquiry does not create a contract. Any figures given in early conversation are indicative only.
A written quotation is valid for 30 days unless stated otherwise, and is based on the information available at the time. If site conditions, access or the scope of the work differ from what was described, we will discuss a revised figure with you before continuing.
Work begins once a written proposal has been accepted and any agreed deposit received. The proposal sets out the scope, programme, payment stages and anything excluded.
Timescales are estimates. Garden work depends on weather, ground conditions, plant availability and the readiness of other trades, and we will keep you informed if any of these affect the programme.
Payment stages are set out in your proposal. Invoices are payable within 14 days of issue unless agreed otherwise. We reserve the right to pause work on overdue accounts and to charge statutory interest on late payment under the Late Payment of Commercial Debts (Interest) Act 1998 where it applies.
If you ask for changes once work has started, we will confirm the effect on cost and programme in writing before carrying them out. Additional work undertaken at your request will be charged in addition to the agreed sum.
Where you engage us as a consumer away from our business premises, you have a statutory right to cancel within 14 days. If you ask us to begin within that period, you may be charged for work already carried out.
If a project is cancelled after work has begun, you remain liable for work completed, materials and plants already ordered, and any costs we have reasonably committed to on your behalf.
Plants are living things. We select and place them with care, but growth and establishment depend on aftercare, weather and site conditions, and we cannot guarantee the survival of individual plants.
Where a maintenance or aftercare plan is provided, following it is a condition of any replacement we may offer as a gesture of goodwill.
Ponds and natural swimming pools require ongoing maintenance and their water chemistry and clarity change with the seasons. We will explain the care each installation needs on handover.
Responsibility for safety around water, including any fencing, supervision or insurance you may need, rests with the owner or occupier once the work is handed over.
You are responsible for providing safe access to the site, for confirming boundaries, and for telling us about buried services, drains, structures or covenants that may affect the work.
You are responsible for obtaining any planning permission, building regulations approval, tree work consent or neighbour agreement required. We are happy to advise, but the obligation remains yours.
Messages sent to us through the website, by email or on social media are not confidential unless we separately agree otherwise, for example in a client contract. We may keep a record of communications for our business purposes.
Content on this website is provided for general information and is updated when we can, but we do not guarantee it is always complete, accurate or current. Using it is at your own risk, and we are not liable for loss arising from reliance on it. This does not affect our responsibilities under a signed project contract or your statutory rights.
Copyright in all drawings, plans, planting schedules and other design material remains with Creative Cultivation. On payment in full you receive a licence to use that material for the property it was prepared for. It may not be used for another site, or passed to another contractor to build, without our written consent.
All images, text, designs and graphics on this website are owned by Creative Cultivation or used with permission. You may not copy, reproduce or reuse them without our written consent, or claim them as your own even with credit given. This is separate from the copyright in project drawings, covered under “Drawings & Copyright” above.
We usually photograph completed projects and may use those images on this website, in print and on social media. Photographs do not identify clients or addresses unless you agree. Tell us at any point if you would prefer your garden not to be photographed or published, and we will respect that.
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our liability in connection with a project is limited to the value of that contract, and we are not liable for indirect or consequential loss. Your statutory rights as a consumer are unaffected.
If something is not right, tell us as soon as possible and we will work with you to put it right. Please raise it in writing to will@creativecultivation.co.uk so we have a clear record of the issue.
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
We may restrict or withdraw access to this website at any time, for example if we reasonably believe these terms have been breached. This does not affect any separate project contract already in place.
These Terms & Conditions, together with our Privacy Policy and any signed project proposal, make up the whole agreement between us for use of this website and, where applicable, for a project. They replace any earlier discussions on the same subject.
If any part of these terms is found unenforceable, the rest will remain in effect.
